This writ petition is directed against the impugned notice dated 29.07.2006, whereby the
Tehsildar, Kathumar claimed a sum of Rs. 71,888/- as road tax.
The case of the petitioner is that the vehicle in question i.e. Bus bearing No. RJP-0136 was sold to respondent No.3 Manohari in December, 2001 and an agreement was also executed between the parties, but it appears that the same has not been transferred in the name of Manohari. In response to the notice, the petitioner also submitted a representation before the
Tehsildar. It is alleged that the Tehsildar has not decided the representation so filed by the petitioner, therefore, this writ petition.
I have heard learned counsel for the petitioner and have also gone through the impugned notice dated 29.07.2006.
This writ petition has been filed by the petitioner without serving notice for demand of justice, therefore, no writ of mandamus can be issued.
However, it is for the Tehsildar concerned to consider the representation so filed by the petitioner expeditiously, but in any case, at this stage no, writ order or direction is required to be issued.
Consequently, the writ petition fails and the same is hereby dismissed.
