Heard.

An application has been moved on behalf of the petitioner that one of the petitioner Radhakishan is dead. His legal representatives are required to be brought on record. He being one of the petitioner, his legal representatives are ordered to be brought on record as prayed.

The order under challenge is an order of appointment of receiver. Learned counsel submits that after proceedings under Section 145

Cr.P.C were initiated, civil litigation has come into being. As and when civil litigation comes into being, parties are relegated back to the civil court to get the matter decided. In that light of the matter, the matter is remanded to the trial court. This question will be raised by the appellant before the trial court.

With these observations, the misc petition is disposed of.
