S.B. CRIMINAL MISC. PETITION NO. 814/2003

S.B. CRIMINAL MISC. PETITION NO. 815/2003

Date : 14.08.2007

HON'BLE MR. BHAGWATI PRASAD, J.

Mr. R.S. Chundawat for the petitioner.

Mr. P.S. Bhati for the respondent. ====

Heard.

The present petitions are filed against an order of taking cognizance and summoning the petitioner. Learned counsel for the respondent points out that the order of the trial court was only for summoning the accused. If the order summoning the accused suffers from any illegality or the petitioner has any defence, he has a right to appear and raise those objections. In that view of the matter, the present petitions are not entertained and disposed of with a direction that the petitioner should present before the court below and raise the objections, if any.

(BHAGWATI PRASAD), J. bjsh
