BHAGWATI MUNDRA v SHRI MOHAN LAL MUTHA - CRLMP Case No. 173 of 2003 [2007] RD-RJ 3969 (16 August 2007)

S.B. CRIMINAL MISC. PETITION NO. 173/2003

Date : 14.08.2007

HON'BLE MR. BHAGWATI PRASAD, J.

Mr. HSS. Kharlia for the petitioner. ====

Heard.

The present petition has been filed for quashing of the FIR.

The grievance of the petitioner is that the police is submitting FR again and again and re-investigating it. The FR has been filed but the same has not been accepted by the Court. If the FR has not been accepted, the police has an un-deniable right to investigation the matter, so long as it desires. There is no limitation prescribed for the same.

With these observations, the misc petition is disposed of.

However, it is made clear that investigating agency would not now un- necessary delay the proceedings and take a definite stand as soon as possible.

(BHAGWATI PRASAD), J. bjsh
