Instant petition has been filed for quashing of FIR registered against accused-petitioners u/ss.307, 147 & 149 IPC.
There is a letter on record dated 25th July, 2003 from which it appears that the Investigating
Officer submitted FR and despite service, complainant has not turned up. Even the
Investigating Officer in his Final Report has recommended to initiate the proceedings against complainant for making false compliant.
In this view of the matter, this criminal misc. petition has become infructuous. The same is, accordingly, dismissed as having become infructuous, along with Stay Petition No.323/01. [AJAY RASTOGI],J.
