LAXMI NARAYAN v SURENDRA SINGH & ORS. - CRLR Case No. 1019 of 2006 [2007] RD-RJ 4014 (17 August 2007)

S.B.Cr. Revision Pet. No.1019/2006

(Laxmi Narayan vs. Surendra Singh & Ors.)

Date of order : August 17, 2007

Mr.H.K.Jain, for the petitioner.

Mr.Narendra Moolchandani, P.P. for the State.

Mr.S.S.Dhillon, for the respondents.

This revision petition has been filed by the complainant against the judgment and order dt. 29.9.2006 passed by the Additional Sessions Judge,

Bhadra in Sessions Case No.08/2004 acquitting the accused-respondents 1 to 4. Against the very judgment and order impugned, the State of Rajasthan has filed a leave to appeal being S.B.Cr.Leave to Appeal No.08/2007 before this

Court. By order dt. 31.1.2007, the leave to appeal to this Court has been granted and appeal has been admitted being S.B.Cr.Appeal No.82/2007 and since the State of Rajasthan has already challenged the judgment and order impugned by way of an appeal, the revision petition by the complainant is not maintainable.

The revision petition is, therefore, dismissed.
