RASHEED v DILIP - CR Case No. 203 of 2007 [2007] RD-RJ 4021 (17 August 2007)

IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR

--------------------------------------------------------

CIVIL REVISION No. 203 of 2007

RASHEED

V/S

DILIP

Mr. RAHUL BATHI, for the appellant / petitioner

Date of Order : 17.8.2007

HON'BLE SHRI N P GUPTA,J.

ORDER

-----

Heard learned counsel for the petitioner.

The learned trial court has rightly closed the right of petitioner to file written statement, and that order has not be challenged in appeal before the learned lower Appellate Court. Likewise, no evidence has been led on the side of the petitioner. In such circumstances, when the learned lower Appellate Court has found the two documents to be proved, and finding the amount having been advanced to the defendant has passed the decree, in my view, the judgment and decree does not suffer from any jurisdictional error requiring any interference in my revisional jurisdiction.

The revision has no force, and the same is, therefore, dismissed.
