IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT
JAIPUR BENCH, JAIPUR ::JUDGMENT::
MASTER ARPIT DADHICH VS. MANAGING COMMITTEE AND ORS.
D.B.CIVIL SPECIAL APPEAL (W) NO.813/2005 UNDER
ORDINANCE 18 OF THE RAJASTHAN HIGH COURT RULES
AGAINST THE ORDER DATED 5.8.2005 PASSED IN
DATE OF JUDGMENT :::: 18.1.2007
HON'BLE JUSTICE MRS.GYAN SUDHA MISRA
HON'BLE JUSTICE MR.K.C.SHARMA
Mr. Manoj Pareek for the appellant.
Ms. Naina Saraf for respondent No.1 & 2.
Mr. RP Singh for respondent No.4
BY THE COURT:
This appeal has been filed in the year 2005 against the order of the learned Single Judge dismissing the writ petition of the petitioner/appellant herein
Master Arpit Dadhich who had filed the writ petition for declaration of his result for Class-XII. The counsel for the CBSE Mr. Singh pointed out that this appeal most likely must have been rendered infructuous as the appellant, in all probability, might not be waiting for two years for declaration of his result and he must have re-appeared in Class-XII examination.
The information appears to be the most probable consequence of the pendency of this litigation and hence we dismiss this appeal as infructuous granting liberty to the counsel for the appellant to file an application for recall of this order in case he has not re-appeared in
Class-XII examination and passed out the same.
