Prosecutor for the State. Perused the order impugned and challan papers.
The case is based on circumstantial evidence i.e. recovery of the articles belonging to the deceased at the instance of the petitioner on furnishing information under section 27 of the Indian Evidence Act. In the instant case, the Investigating Officer has not yet been examined. In my view, it is not a fit case to release the petitioner on bail in view of the recovery alleged to have been effected at the instance of the petitioner.
The bail application filed by the petitioner under section 439 Cr.P.C. is, therefore, dismissed.
