GOVERDHAN SINGH v HARISINGH & ORS - CMA Case No. 1047 of 2007 [2007] RD-RJ 4115 (22 August 2007)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR
--------------------------------------------------------
CIVIL MISC. APPEAL No. 1047 of 2007
GOVERDHAN SINGH
V/S
HARISINGH & ORS
Mr. VINAY JAIN, for the appellant / petitioner
Mr. RAJESH JOSHI, for the respondent
Date of Order : 22.8.2007
HON'BLE SHRI N P GUPTA,J.
ORDER
-----
Heard learned counsel for the petitioner, perused the impugned order.
It is not the averment of the plaintiff-appellant that he has sown any crop on the land, while according to the defendants, they had sown the crop. The suit was filed on 10.7.2006. The Commissioner on 12.8.2006 had found the
Jawar crop to be existing with the height of the plant to be 5 to 6 fts. In my view, in these circumstances, the impugned order doesn't require any interference in my appellate jurisdiction. The appeal is, therefore, dismissed summarily.
