Learned counsel for the petitioner does not want to press the instant bail application at this stage, however, seeks liberty to move a fresh bail application after the statement of the Doctor, who conducted autopsy of the deceased is recorded.

The bail application filed by the petitioner under section 439 Cr.P.C. is, therefore, dismissed as not pressed at this stage with the liberty to file a fresh bail application after the statement of the Doctor, who conducted the autopsy of the deceased is recorded. The trial court shall record the statement of the Doctor, who conducted the autopsy of the deceased on priority.
