MANISH SHARMA v STATE - CRLMB Case No. 3753 of 2007 [2007] RD-RJ 4178 (24 August 2007)

S.B.Cr. Misc. Bail Appl. 3753/2007

(Manish Sharma vs. State of Rajasthan)

Date of order : August 24, 2007

HON'BLE MR.H.R.PANWAR,J.

Mr.Mridul Jain, for the petitioner.

Mr.Ashok Upadhyaya, P.P. for the State.

Heard learned counsel for the petitioner and the Public

Prosecutor for the State. Perused the order impugned and the police investigation diary.

It is contended by the learned counsel for the petitioner that the petitioner is maternal uncle-in-law of the deceased and has nothing to do with the demand of dowry.

I have carefully gone through the investigation diary including the note written by the deceased herself. There is a specific allegation against the petitioner by name and the fact that deceased died within four months otherwise than under normal circumstances at her in-laws house, in my view, it is not a fit case to grant anticipatory bail to the petitioner.

The bail application filed by the petitioner under section 438 Cr.P.C. is, therefore, dismissed.
