In the course of arguments, it was canvassed on behalf of the petitioners that this Court while deciding SBCWP No.3087/2007, 4437/2007 and 4476/2007 directed the petitioners to make representation to the Vice Chancellor for availing of one special chance to appear in First MBBS Examination, 2007.

Although, petitioners appeared in that examination as failure students but if they are afforded one more chance, result thereof shall be counted in the first

MBBS Examination and not as a supplementary chance.

While making compliance of the order of this Court, the Assistant Registrar of the Rajasthan University has vide order dated 5/7/2007 which is eventually issued in compliance of the directions of the Vice

Chancellor, included only five candidates who are petitioners in first two petitions whereas none of the petitioners in SBCWP No.4476/2007 has been included therein. Learned counsel for the University however is not in a position to explain as to why none of the seven petitioners were included in the order dated 25/6/2007 while other similarly situated candidates have been given the benefit of special chance.

In the facts of the case therefore, respondent-University is directed to examine the case of the petitioners afresh and in case, case of the petitioners is found similar to those five included in the order dated 25/6/2007, pass a speaking order within one week from the date certified copy of this order is produced before them.

With these observations, the writ petition is disposed of.
