Heard learned counsel for the petitioners and the Public
Prosecutor for the State. Perused the order impugned.
It is contended by the learned counsel for the petitioners that similarly situated co-accused viz. Bhagwan Lal, Poonam
Chand, Heera Lal, Narayan, Gopal, Kanwar Lal, Balu, have been granted bail by this Court and the case of the present petitioners is not distinguishable from that of co-accused, who have already been granted bail.
Having regard to the facts and circumstances of the case and the fact that the similarly situated co-accused have already been granted bail, I consider it just and proper to enlarge the accused petitioners on bail.
Accordingly, the bail application filed under Sec. 439
Cr.P.C. is allowed and the petitioners Kanti Lal s/o Bhagwan
Dangi, Shankar Lal s/o Bagdi Ram Dangi, Ram Chandra s/o
Ganga Ram Dangi, Chain Ram s/o Panna Lal Dangi, Kanhaiya Lal s/o Panna Lal Dangi, Jagdish s/o Poonam Chand Dangi, Ram Lal s/o Partha Dangi, Yudhishthar s/o Shankar Lal Dangi, Magan Lal s/o Ratan Lal Dangi, Ram Singh s/o Narayan Dangi and Ramesh s/o Bhagwan Lal Dangi be released on bail in FIR No.253/2007,
P.S. Arnod provided each of them furnishes a personal bond in a sum of Rs.20,000/- with two sound and solvent sureties in the sum of Rs.10,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
