Heard learned counsel for the petitioners and the Public
Prosecutor for the State. Perused the order impugned. Carefully gone through the statement of the prosecutrix, who is major, recorded by the Judicial Magistrate under section 164 Cr.P.C. In her statement, the prosecutrix has clearly stated that she married with Gopal, however, there were some disputes between them and ultimately she left the house of Gopal and is living at her parents house and fell in love of one Vikas.
The allegation against the petitioners is that they asked the prosecutrix to marry with Vikas. No other allegation except asking the prosecutrix to marry with Vikas. The allegation of rape is against Vikas.
Having considered the totality of facts and circumstances of the case and taking into account the oral arguments advanced by both the parties, I think it just and proper to enlarge the accused petitioners on bail.
Accordingly, the bail application filed under Sec. 439
Cr.P.C. is allowed and petitioners Sohan s/o Kushala Meena,
Rang Lal s/o Dhan Ji Meena, Govind s/o Dalla Ji Meena and
Nanji alias Nagji s/o Dhan Ji Meena be released on bail in FIR
No.84/2007, P.S. Suhagpura, Distt. Chittorgarh provided each of them furnishes a personal bond in a sum of Rs.20,000/- with two sound and solvent sureties in the sum of Rs.10,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
