Instant petition is directed against the order dated 10th May, 2001 whereby application of petitioner seeking permission to transfer the vehicle in question, was rejected by learned trial Judge.
Petitioner was registered owner and during pendency of criminal case instituted, application was filed by him u/s.457 Cr.P.C. for taking possession of the vehicle in question, which was allowed by this court vide order dated 11th June, 1999 and he was permitted to take possession of the vehicle on furnishing supurdginama of Rs.3 lacs with surety and condition was also incorporated that he will not transfer the vehicle during pendency of Criminal Case
No.375/94. It appears that in terms of order of this court, the vehicle was handed over to petitioner, later on filed application seeking permission for transfer of vehicle, which has been rejected by learned trial Judge by a detail order.
This court has gone through the order and does not find any infirmity in the order impugned which may call for interference.
Consequently, the misc. petition fails and is hereby dismissed. [AJAY RASTOGI],J.
