DHOKAL RAM v MEER KHAN & ORS. - CMA Case No. 01881 of 2006 [2007] RD-RJ 437 (19 January 2007)

S.B. CIVIL MISC. APPEAL NO.1881/2006 (DRJ)

Date of Order :: 19th January 2007

HON'BLE MR. JUSTICE DINESH MAHESHWARI

Mr.Rajesh Bhati for the appellant

This appeal submitted against the common award dated 26.07.2005 insofar it relates to Claim Case No.95/2000 carries a major defect that the memo of appeal is not accompanied by Vakalatnama and only a memo of appearance has been filed though the counsel appearing for the appellant in this appeal was not the counsel before the

Tribunal concerned. Learned counsel Mr.Rajesh Bhati submits that despite efforts, he has not been able to complete his instructions in this matter and expresses his inability to remove the defects pointed out by the office.

In this view of the matter, there appears no reason or justification to continue with this appeal. The appeal is, therefore, dismissed as incompetent.

(DINESH MAHESHWARI), J.
