KAPIL DEV v STATE - CRLMB Case No. 4051 of 2007 [2007] RD-RJ 4482 (11 September 2007)

S.B.Cr.Misc. Bail Appli. No.4051/2007

(Kapil Dev Vs. State of Rajasthan)

Date of order : September 11, 2007

HON'BLE MR.H.R.PANWAR,J.

Mr.Sanjeev Sharma, for the petitioner.

Mr.Ashok Upadhyaya, P.P. for the State.

Mr.Devendra Mehla, for complainant.

Heard learned counsel for the petitioner and the Public

Prosecutor for the State assisted by counsel for the complainant. Perused the order impugned and the police investigation diary.

There are serious allegations against the petitioner that he embezzled a sum of Rs.12,77,920/-. In my view, in such matters, a custodial interrogation is necessary. Hence, no case for anticipatory bail under section 438 Cr.P.C. is made out.

The bail application filed by the petitioner under section 438 Cr.P.C. is, therefore, dismissed.
