Instant petition has been filed against the order dated 6th July, 2000 whereby learned trial
Judge took cognizance against accused-petitioner u/ss.323 & 341 IPC against which revision petition was preferred, which was dismissed on 23rd March, 2001.
The Investigating Officer submitted FR, but on submitting protest petition and after recording statement u/ss.200 & 202 Cr.P.C., learned trial Judge took cognizance. The order is of July, 2000. The matter must have been finally concluded by now looking to the offence being committed in the instant petition. Even otherwise, all objections are available which could be raised by the accused-petitioner either at the stage of framing charge or during trial.
Consequently, the misc. petition fails and is hereby dismissed. [AJAY RASTOGI],J.
