Heard learned counsel for the petitioner and the Public
Prosecutor for the State. Perused the order impugned as well as the police investigation diary.
It is contended by the learned counsel for the petitioner that mainly allegation of subjecting the deceased harassment or cruelty in connection with demand of dowry, more particularly a sum of Rs.50,000/-is against the husband of the deceased viz.
Vinod. So far as present petitioner is concerned, he is father-in- law of the deceased, and mother-in-law Smt. Panna Bai has been granted bail by a Co-ordinate Bench of this Court vide order dt. 8.8.2007 and the case of the present petitioner is not distinguishable from that of co-accused, who has already been granted bail.
Having regard to the facts and circumstances of the case and the fact that there are serious allegations against the husband of the deceased but so far present petitioner is concerned, he appears to have been similarly situated to that of co-accused Smt. Panna Bai, who has been granted bail, without commenting on the merit of the case, I consider it just and proper to enlarge the accused petitioner on bail.
Accordingly, the bail application filed under Sec. 439
Cr.P.C. is allowed and it is directed that petitioner Nathu Lal s/o
Narayan be released on bail in FIR No.150/2007, P.S. Badi
Sadri, Distt. Chittorgarh provided he furnishes a personal bond in a sum of Rs.20,000/- with two sound and solvent sureties in the sum of Rs. 10,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
