Learned counsel frankly submits that the amount involved in the present matter being of Rs.4,331/-, this appeal is not competent in view of the provisions of Section 173 (2) of the Motor Vehicles Act; however, the present appeal has been preferred by the appellant only in abundant caution least any question of finality of findings may arise against it in relation to other appeals arising out of the common award. Learned counsel submits that the appellant shall stand advised not to press this appeal without prejudice to their rights in other matters. The submissions seem reasonable and are accepted subject, of course, to all just exceptions.
The appeal is dismissed as not pressed.
