MALDAN v UNION OF INDIA - CRES Case No. 04761 of 2006 RD-RJ 4613 (18 September 2007)
S.B.Civil Restoration Application No.4761/2006 DR(J)
Union of India and others.
Date : 18.9.2007
HON'BLE MR. PRAKASH TATIA, J.
Mr.N Trivedi, for the applicant.
The application has been filed for condonation of delay of 3609 days in filing the restoration application.
The applicant's S.B. Civil First Appeal No.68/1994 was dismissed because of per-emptory order passed by this Court as back as on 24.9.1996. The applicant is seeking condonation of delay in filing the restoration application of 3609 days on the ground that learned counsel for the applicant was under impression that the service is already complete.
The reason given is not convincing and cannot be accepted as just ground for not taking care of case file pending for almost 10 years.
In view of the above, the application for condonation of delay is hereby dismissed.
Consequently, the restoration application is also dismissed.
(PRAKASH TATIA), J.
