LILY GUPTA v STATE AND ORS - CW Case No. 3212 of 2001 RD-RJ 4801 (26 September 2007)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
AT JAIPUR BENCH, JAIPUR
S.B. CIVIL WRIT PETITION NO. 3212/2001
SMT. LILY GUPTA Vs. STATE OF RAJASTHAN & ORS.
HON'BLE MR. JUSTICE K.S. RATHORE
Mr. Rajesh Chaturvedi for
Dr. P.C. Jain for the petitioner.
Mr. B.S. Chhaba, Dy. GA for the State.
Mr. Rizwan Ahmed for
Mr. Ajeet Bhandari for respondent No.3 JDA.
Mr. Ram Manohar Sharma for
Mr. Sudesh Bansal for the respondent No.4.
By way of this writ petition, limited relief has been claimed by the petitioner as the JDA is not granting/sanctioning the building plans submitted by the petitioner in the year 1985. in response to the writ petition, the respondent JDA has filed reply and along with the reply they have submitted a letter dated 18.08.2001
(Annexure-R/3-1), whereby the petitioner's counsel was informed that the land in question is acquired and plot belonging to the petitioner is situated at 80 feet wide road and the same is under acquisition and plan of the
Housing Cooperative Society is also not approved, therefore, the building plans submitted by the petitioner cannot be approved.
Having heard the rival submissions of the respective parties, I find no illegality in refusing to grant/sanction approval of the building plans as the petitioner has got no case in her favour.
Consequently, the writ petition fails and the same is hereby dismissed.
The stay application also stands rejected.
