Heard learned counsel for the petitioner and the Public
Prosecutor for the State. Perused the order impugned and the police investigation diary.
The allegation against the petitioner is that he has been indulging in manufacturing illicit liquor and selling by affixing fake/spurious label of Ganganagar Sugar Mill. At the relevant time, the police recovered 400 ltrs. of spirit meant for manufacturing illicit liquor and other articles relating to such manufacturing.
From perusal of the police investigation diary, it appears that number of cases of similar nature are pending against the present petitioner and other persons involved in the matter.
Keeping in view the serious allegation against the petitioner of manufacturing illicit liquor at large scale and selling by affixing the fake/spurious label of Ganganagar Sugar Mill, an authorized distillery of the State and the matter is at the investigation stage, in my view, it is not a fit case to release the petitioner on bail at this stage.
The bail application filed by the petitioner under section 439 Cr.P.C. is, therefore, dismissed. [H.R.PANWAR],J. m.asif/-
