This writ petition is preferred by the petitioner as the respondents wants to remove the 'Pan
Thadi' (betel shop) of the petitioner for which the petitioner is regularly paying rent to the Municipal
Corporation. Therefore, against the notice issued to the petitioner to remove his betel shop, this writ petition has been filed by the petitioner.
Learned counsels appearing for the respective parties submit that the similar controversy has been decided by the co-ordinate Bench of this Court vide order dated 22.02.2007 rendered in S.B. Civil Writ
Petition No. 6044/1997- Chhagan Lal Vs. State of Raj. &
In the light of the ratio decided by the co- ordinate Bench of this Court in the aforementioned writ petition of Chhagan Lal (supra), the present writ petition stands disposed of with liberty to the petitioner to make a representation to the respondents and if the representation is received by the respondents, it is expected of them to consider and decide the same expeditiously as possible to provide a alternative site for location of betel shop.
With the aforesaid observations, the writ petition stands disposed with no order as to costs.
