Aishwary Jain
Vs.
The Registrar, Rajasthan University of Health & Science,
Jaipur and anr.
Date of order :- 28/9/2007.
HON'BLE MR.JUSTICE MOHAMMAD RAFIQ
Shri Dileep Sinsinwar for the petitioner.
Shri R.A. Katta for the University.
****
BY THE COURT:-
This writ petition has been filed by the petitioner with the grievance that the University pursuant to the order passed by the Vice Chancellor, dated 25/6/2007 permitted some similarly situated candidates to appear in M.B.B.S. Part-I Examination upto
July 2007 as a special chance while accepting their representations. The petitioner is also on the same footing of analogy since the respondents have permitted similarly situated candidates to appear in the aforesaid examination. In fact, the respondents have declared the result of the examinations of some of the petitioners in which some of petitioners have been declared passed.
Petitioner now apprehends that unless a special chance which is being provided to the other similarly situated
SBCWP NO.7707/2007. candidates/petitioners to the petitioner as well, the examination in which petitioner appeared and even has been declared passed, the entire academic career of the petitioner would go waste.
In the facts of the case, I set the petitioner as liberty to make a representation to the Vice
Chancellor in the light of the observation made by this
Court in SB Civil Writ Petition No.3087/2007 (Har Lal
Singh and ors. Vs. Vice Chancellor, University of
Rajasthan, Jaipur and ors.) decided on 31/5/2007.
If any such representation is made, it is expected of the Vice Chancellor of the University of
Rajasthan to consider and decide the same within ten days thereafter on the same lines by giving a special chance to the petitioner as has earlier been given in similarly situated petitioners in SBCWP No.3087/07, referred to above.
With the above directions, the writ petition is disposed of.
