NARAIN NATH v STATE - CRLMB Case No. 4867 of 2007 RD-RJ 4887 (1 October 2007)
S.B.Cr.Misc. Bail Appli. No.4867/2007
(Narain Nath vs. State of Rajasthan)
Date of order : October 01, 2007
Mr.Sandeep Mehta, for the petitioner.
Mr.Ashok Upadhyaya, P.P. for the State.
Heard learned counsel for the petitioner and the Public
Prosecutor for the State. Perused the order impugned.
Looking to the serious allegations against the petitioner that he was in possession of illicit liquor, without commenting on the merit of the case, in my view, it is not a fit case to grant anticipatory bail to the petitioner, on the contrary, in such matters, a custodial interrogation is necessary.
The bail application filed by the petitioner under section 438 Cr.P.C. is, therefore, dismissed.
