CHOTU NATH v STATE - CRLMB Case No. 4814 of 2007 RD-RJ 4923 (4 October 2007)
S.B.Cr.Misc. Bail Appli. No.4814/2007
(Chhotu Nath vs. State of Rajasthan)
Date of order : October 04, 2007
Mr.Vishal Sharma, for the petitioner.
Mr.Ashok Upadhyaya, P.P. for the State.
Heard learned counsel for the petitioner and the Public
Prosecutor for the State. Perused the order impugned and the police investigation diary.
It is contended by learned counsel for the petitioner that there is a cross-case. Be that as it may, from perusal of the police investigation diary, it appears that the petitioner was armed with knife and inflicted repeated injuries to Raju
Nath. In this view of the matter, in my view, it is not a fit case to grant anticipatory bail to the petitioner.
The bail application filed by the petitioner under section 438 Cr.P.C. is, therefore, dismissed.
