INDER CHAND v STATE - CRLMB Case No. 4780 of 2007 RD-RJ 4928 (4 October 2007)
S.B.Cr.Misc. Bail App. No.4780/2007
(Inder Chand vs. State of Rajasthan)
Date of order : October 04, 2007
Mr.R.S.Choudhary, for the petitioner.
Mr.Vishal Raj Mehta, Public Prosecutor.
Mr.J.S.Choudhary, for the complainant.
Heard learned counsel for the petitioner and the Public
Prosecutor for the State. Perused the order impugned as well as the police investigation diary.
It is contended by learned counsel for the petitioner that nothing has to be recovered since the tractor has already been recovered and the matter has already been investigated so far as present petitioner is concerned. It is further contended by the learned counsel for the petitioner that the investigation and trial are likely to take a long time and the offences are triable by the
Court of Judicial Magistrate.
Having regard to the facts and circumstances of the case and taking into account the oral arguments advanced by both the parties, I consider it just and proper to enlarge the accused petitioner on bail.
Accordingly, the bail application filed under Sec. 439
Cr.P.C. is allowed and it is directed that petitioner Inder Chand s/o Duli Chand be released on bail in FIR No.160/2006, P.S.
Ratangarh provided he furnishes a personal bond in a sum of
Rs.20,000/- with two sound and solvent sureties in the sum of
Rs.10,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
