This writ petition is directed against the order dated 27/2/2007 whereby, the learned Civil
Judge (Jr.Div.) Ajmer rejected the application filed by the petitioner for producing the additional witnesses on record. Learned trial court while rejecting the said application, noted that already sufficient opportunities have been granted to the petitioner for the said purpose inasmuch as, the court on 17/10/2003 granted last opportunity to the petitioner for adducing evidence on cost. Thereafter, the matter remained pending on the evidence of the plaintiff and sufficient number of witnesses have been examined. The petitioner cannot take the
SBCWP NO.8130/2007. procedure of law so easily that even after the last opportunity granted on 17/10/2003, he prolonged the matter for last more than four years to conclude his evidence.
The learned trial court has not committed any error of law in rejecting the application.
The writ petition being devoid of merit is therefore dismissed in limine.
