Mr. V.L.Thanvi for the appellant.

Learned counsel submits that he has contacted the appellant for the purpose of making immediate compliance of the provisions of Section 173 of the Motor Vehicles Act; however, as per instructions, submits that the appellant is bed-ridden and is not in a position to make compliance today.

However, learned counsel assures that the appellant shall carry out the compliance within 3 days from today. If the appellant does so and produces requisite certificate within a week from today, the matter be placed for admission on 06.02.2007, else the appeal shall stand dismissed without reference to the court.
