Learned counsel for the petitioner submits that he does not want to press the bail application filed under Sec.439
Cr.P.C. at this stage, however, seeks a liberty to file a fresh bail application after the statement of prosecutrix is recorded by the trial court.
The bail application filed by the petitioner under Sec. 439 Cr.P.C is, therefore, dismissed as not pressed with the liberty to file a fresh bail application after the statement of the prosecutrix is recorded by the trial court. The trial court shall record the statement of the prosecutrix on priority basis.
