This letter petition is being sent to this by petitioner Lungi Devi for release of her husband on emergency parole. Her husband Chaukha Ram is convict for offence under the NDPS Act and is suffering imprisonment of 10 years awarded to him at
Central Jail Jodhpur. Report of the Superintendent of
Police indicates that there is no such provision for release of a convict who is an accused under the NDPS
Act. However, case of the convict-Chaukha Ram for releasing him on parole has been forwarded to the
State Advisory Parole Committee.
In the facts of the case, it is therefore directed that the final decision on the question of release of Chaukha Ram on parole shall be considered by the State Advisory Parole Committee within a period of three months from the date of receipt of this order. A copy of this order be forwarded to the
Superintendent Central Jail, Jodhpur.
The writ petition is accordingly disposed of.
