Heard learned counsel for the petitioner and the Public
Prosecutor for the State. Perused the order impugned.
It is contended by learned counsel for the petitioner that though the bail application of co-accused has been dismissed under section 438 Cr.P.C. but the case of the petitioner is distinguishable from that of co-accused, whose bail application has been dismissed.
From perusal of the order impugned, in my view, the case of the petitioner is similar to that of co-accused, whose bail application under section 438 Cr.P.C. has been dismissed.
In this view of the matter, the instant bail application filed by the petitioner under section 438 Cr.P.C. is, therefore, dismissed.
