Heard learned counsel for the petitioners and the Public
Prosecutor for the State. Perused the order impugned as also the police investigation diary. I have carefully gone through the statement of the injured and his injury report. The injured has suffered fracture by blunt object on metacarpal bone of right hand. No other bony injury was noticed by the Radiologist.
Having regard to the facts and circumstances of the case and keeping in view the nature of the injury, which is on metacarpal bone of right hand, taking into account the oral arguments advanced by both the parties, I consider it just and proper to enlarge the accused petitioners on bail.
Accordingly, the bail application filed under Sec. 439
Cr.P.C. is allowed and it is directed that petitioners Vasaya Khan s/o Firoz Khan, Karim Khan s/o Ramjan Khan, Alla Basaya s/o Ali
Mohammad and Arbab Khan s/o Dade Khan be released on bail in CR. No.82/2007, P.S. Sarwana provided each of them furnishes a personal bond in a sum of Rs.20,000/- with two sound and solvent sureties in the sum of Rs.10,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
