Learned counsel for the petitioner submits that the petitioner has been arrested and, therefore, the instant bail application has become infructuous.

In view of the statement of the learned counsel for the petitioner, the bail application filed by the petitioner under section 438 Cr.P.C. is dismissed as having become infructuous.
