HARDEEP SINGH & ANR. v STATE - CRLMB Case No. 4909 of 2007 [2007] RD-RJ 5196 (29 October 2007)

S.B.Cr.Misc. Bail App. No.4909/2007

(Hardeep Singh & Anr. Vs. State of Rajasthan)

Date of order : October 29, 2007

HON'BLE MR.H.R.PANWAR,J.

Mr.Rajendra Charan, for the petitioners.

Mr.Ashok Upadhyaya, Public Prosecutor.

Mr.Rajednra Charan submits that he has filed the power on behalf of the petitioners.

Heard learned counsel for the petitioners and the Public

Prosecutor for the State. Perused the order impugned and the police investigation diary. I have carefully gone through the injury report of Sikander, the sole injured. The injuries suffered by him are by blunt object, except the injury No.5, which is by sharp edged weapon on little finger.

From perusal of the x-ray report, the injury on little finger was found to be resulted in bony injury. The other injuries are by blunt object on non-vital parts.

Having considered the totality of facts and circumstances of the case and the fact that the injury was caused by sharp- edged weapon on little finger and it has been stated by the learned counsel for the parties that the injured was discharged from the hospital on 21.8.2007, without commenting on the merit of the case, I think it just and proper to enlarge the accused petitioners on bail.

Accordingly, the bail application filed under Sec. 439

Cr.P.C. is allowed and it is directed that petitioners Hardeep

Singh s/o Jaswant Singh and Omkar s/o Sharwan Kumar be released on bail in FIR No.318/2007, P.S. Jawahar Nagar provided each of them furnishes a personal bond in a sum of

Rs.20,000/- with two sound and solvent sureties in the sum of

Rs.10,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
