MANOJ v STATE - CRLMB Case No. 5302 of 2007 RD-RJ 5204 (29 October 2007)
S.B.Cr.Misc. Bail Appli. No.5302/2007
(Manoj vs. State of Rajasthan)
Date of order : October 29, 2007
Mr.Suresh Kumbhat, for the petitioner.
Mr.Ashok Upadhyaya, P.P. for the State.
Heard learned counsel for the petitioner and the Public
Prosecutor for the State. Perused the order impugned.
It is contended by learned counsel for the petitioner that the goods have been recovered from one Sugan Raj Jain.
Be that as it may, from perusal of the order impugned, it appears that there are serious allegations of misappropriating the goods entrusted to the petitioner and the petitioner entered into a criminal conspiracy. In the circumstances, therefore, in my view, it is not a fit case to grant anticipatory bail to the present petitioner at this stage.
The bail application filed by the petitioner under section 438 Cr.P.C. is, therefore, dismissed.
