Heard learned counsel for the petitioners, learned Public Prosecutor for the State and perused the relevant documents placed before me.

Learned counsel for the petitioners has argued that in fact the genesis of the dispute lies in the fact that when they demanded toll tax, complainant refused to pay the same due to which, hot words were exchanged resulting into scuffle in which complainant received three simple injuries out of which, two were lacerated wounds and one is bruise. Petitioners are in jail since 3/10/2007 and investigation is almost complete and their detention is no more needed for any purpose.

Learned Public Prosecutor has opposed the bail application.

Without expressing any opinion on the merits of the case but taking into consideration the aforesaid arguments, I deem it appropriate to enlarge the petitioners on bail during trial.

In the result, this bail application u/S.439 is allowed and it is directed that petitioners

Kuldeep S/o Dhani Ram Gurjar, Ram Bharosi S/o Ganga

Ram Gurjar, Puran Chand S/o Shiv Lal Gurjar, Ramesh

S/o Tejpal Gurjar, Ramavtar S/o Chanduram Gurjar,

Satish S/o Balvir Yadav, Balvir S/o Badluram Gurjar and Balraj S/o Ram Singh Gurjar shall be released on bail in F.I.R. No.395/2007 P.S. Tijara, District

Alwar for offences under Sections 143, 341 and 327

IPC subject to each of them furnishing a personal bond in the sum of Rs.30,000/- together with two sureties in the sum of Rs.15,000/- each to the satisfaction of the trial Court for their appearance before that court on all dates of hearing until conclusion of the trial.
