SANJAY AND ANR v STATE - CRLMP Case No. 597 of 2006  RD-RJ 5287 (1 November 2007)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN
AT JAIPUR BENCH
S.B. CRIMINAL MISC. PETITION NO.597/06
Sanjay & Anr. Versus State
DATE OF ORDER :: 01/11/2007
HON'BLE MR. JUSTICE AJAY RASTOGI
Mr. D.D. Khandelwal, for petitioners
Mr. Arun Sharma, Public Prosecutor
Instant petition has been filed assailing order dated 26th November, 2005 whereby learned trial Judge took cognizance against accused- petitioners. Undisputedly, it is revisable order and revision petition against said order is maintainable. In view of availability of remedy of revision to accused-petitioners, this court is not inclined to exercise inherent jurisdiction available u/s.482 Cr.P.C.
Consequently, the misc. petition stands dismissed. However, petitioners will be at liberty to file revision petition and since the matter remained pending for sometime, application, if filed under Limitation Act seeking condonation the same may be objectively considered. Relevant papers be made available to petitioners on furnishing xerox copies of the same. [AJAY RASTOGI],J.
