SHRI GOPAL v STATE & ORS - SAW Case No. 908 of 2006 [2007] RD-RJ 5310 (2 November 2007)
IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR
--------------------------------------------------------
SPL. APPL. WRIT No. 908 of 2006
SHRI GOPAL
V/S
STATE & ORS
Mr. MS SINGHVI, for the appellant / petitioner
Mr. SANDEEP SHAH & Mr. BL BHATI, DY.G.A., for the respondent
Date of Order : 2.11.2007
HON'BLE SHRI N P GUPTA,J.
HON'BLE SHRI MUNISHWAR NATH BHANDARI,J.
ORDER
-----
Heard learned counsel for the appellant.
By the impugned order the learned Single Judge has directed the respondents to decide the application of the petitioner filed under Section 90-B, and till then status quo was ordered to be maintained and also leaving it open that if grievance of the petitioner remains after decision of the said application he will have liberty to approach again. This order was passed considering the submission of the learned counsel for the respondent that application of the petitioner under Section 90-B is still pending.
In that view of the matter, we do not find any sufficient ground to interfere with the impugned order. The appeal is, therefore, dismissed summarily. The respondents are directed to decide the application even now most expeditiously.
