Heard learned counsel for the petitioner and the Public
Prosecutor for the State. Perused the order impugned as also challan papers and statement of prosecutrix.
From the perusal of the statement of the prosecutrix, it appears that the prosecutrix herself took a bag with her and went to the bus stand, boarded the bus and went in the bus to a place which the petitioner and the prosecutrix decided, there it is alleged that the petitioner came on the motor cycle as determined by the parties and took her. The prosecutrix visited with the petitioner to various places like Banswara, Ratlam, Delhi etc and stayed in number of hotels including Surat, Aanad, Himmatnagar, Baroda etc.
Looking to the facts and circumstances of the case and keeping in view the statement of prosecutrix, having considered the oral arguments advanced by both the parties, I think it just and proper to enlarge the accused petitioner on bail.
Accordingly, this bail application filed under Sec. 439 Cr.P.C. is allowed and it is directed that petitioner Deepak Pandya S/o Shri Ravi
Shankar be released on bail in FIR No. 88/2007, P.S. Jhallara
(Udaipur) provided he executes a personal bond for a sum of Rs. 20,000/- with two sound and solvent sureties in the sum of Rs. 10,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
