Heard learned counsel for the petitioners and the Public
Prosecutor for the State. Perused the order impugned.
It is contended by learned counsel for the petitioners that petitioners have no role in commission of the crime.
Per contra, learned Public Prosecutor opposes the bail application and submits that under the garb of entering into the compromise, the petitioners and others have taken a sum of
Rs.2,00,000/- from the first informant and did not execute the compromise.
Keeping in view the serious allegations and the question of recovery of Rs.2,00,000/- is involved, which alleged to have been taken by deceitful means, in my view, it is not a fit case to grant anticipatory bail to the petitioners, on the contrary in such matters, custodial interrogation is necessary.
The bail application filed by the petitioners under section 438 Cr.P.C. is, therefore, dismissed.
