Heard learned counsel for the petitioners and the Public

Prosecutor for the State as also the counsel appearing for the first informant. The first informant is also present in person.

Learned counsel for the petitioners submits that the allegation against the present petitioners is for the offence under Section 498-A

IPC and the parties have compromised the matter. This fact has been admitted by the first informant and submits that he has compromised the matter and no evidence is likely to be given against the present petitioners. The complainant first informant has been identified by his counsel Mr. C.S.Rajpurohit.

Looking to the facts and circumstances of the case and the fact that the offence is punishable under Section 498-A IPC and the parties have compromised the matter as stated by the first informant and his counsel, without commenting on the merit of the case, having considered the oral arguments advanced by both the parties, I think it just and proper to enlarge the accused petitioners on bail.

Accordingly, this bail application filed under Sec. 439 Cr.P.C. is allowed and it is directed that petitioners Smt. Inder Kanwar W/o Shri

Chandan Singh and Smt. Desh Kanwar W/o Shri Vijay Singh be released on bail in FIR No. 121/07 P.S. Shivana, district Barmer, provided each of them executes a personal bond for a sum of Rs. 20,000/- with two sound and solvent sureties in the sum of Rs. 10,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
