Mr.Pradeep Shah, for the petitioners.

Mr.Ashok Upadhyaya, P.P. for the State.

Learned counsel for the petitioners submits that he does not want to press the bail application filed under

Sec.439 Cr.P.C. at this stage, however, seeks liberty to file a fresh bail application after the statement of injured, sole eye- witness Jabar Singh is recorded. However, learned Public

Prosecutor submits that there are three witnesses viz. Peer

Mohammed, Jeeva Ram and Ranjit Singh, who are also eye witnesses.

Be that as it may, the bail application filed by the petitioner under section 439 Cr.P.C. is dismissed as not pressed with the liberty sought for.
