He submits that the case was found against co-accused Jai
Singh against whom, the police has already filed the challan.
So far as present petitioners are concerned, no case is found against them. There is no ground to arrest them.
In view of the statement of the learned Public
Prosecutor, the bail application under section 438 Cr.P.C. has become infructuous since there is no accusation against the present petitioners. The bail application filed by the petitioners under section 438 Cr.P.C. is, therefore, dismissed as having become infructuous.
