By this revision petition under Section 397 read with Section 401 Cr.P.C., a challenge is given to the judgment dated 29.10.2007, whereby learned Additional Sessions Judge
(Fast Track) No.1, Bikaner acquitted the respondent Nos. 2 to 5 from the offences under Section 3/8 of the Rajasthan Bovine
Animal (Prohibition of Slaughter and Regulation of Temporary
Migration or Export) Act, 1995.
The allegation of the petitioner is that the trial court while acquitting the respondents has not adequately and properly appreciated the statement of PW-4 Dr. Birma Ram.
I have examined the order impugned.
Learned trial court after considering the entire evidence available on record, extended the benefit of doubt in favour of the respondents. I do not find any error in the order impugned that may warrant interference of this Court under its revisional jurisdiction. The statement of Dr. Birma Ram (PW-4) cannot be re-appreciated in the revisional jurisdiction.
The revision petition is accordingly dismissed.
