This is second bail application.
Heard learned counsel for the petitioner and the Public
Prosecutor for the State. Perused the order impugned.
After rejecting the first bail application, I do not find any change in the circumstance. From perusal of the order impugned, it appears that 35 kgs. of poppy straw has been recovered from personal possession of the petitioner, though, it is less than the commercial quantity but much higher than the small quantity. In my view, the quantity of alleged contraband is on higher side. In the circumstances, therefore, in my view, it is not a fit case to release the petitioner on bail.
The bail application filed by the petitioner under section 439 Cr.P.C. is, therefore, dismissed.
