It is contended by the learned counsel for the petitioner that co-accused Sohan Lal and Laxman have been released on bail under section 439 Cr.P.C.
The petitioner seeks anticipatory bail under section 438
Cr.P.C. The allegation against the petitioner is that before
Tehsildar, he identified a person, who by impersonating, executed a sale deed transferring the land belonging to the true owner. In this view of the matter, prima facie it cannot be said that the petitioner is not involved in the commission of the crime and, therefore, in my view, it is not a fit case to grant anticipatory bail to the petitioner.
The bail application filed by the petitioner under section 438 Cr.P.C. is, therefore, dismissed.
