This petition under Section 397 read with 401 Cr.P.C. is preferred to assail validity of the order dated 4.10.2007 passed by learned Sessions

Judge, Pratapgarh upholding the order dated 26.9.2007 passed by Juvenile Justice Board, Chittorgarh refusing to release the petitioner on bail.

I have perused the order impugned that clearly mentions that "the accused may engage in smuggling activities after releasing him on bail. The possibility of joining the gang involved in such activities could not be ruled out and, therefore, release of present accused although he is below 18 years of age, would defeat the ends of justice". The orders passed by learned Juvenile Justice Board and learned Sessions Judge are apparently just and proper and are in interest of the accused himself. No interference, therefore, is warranted under Section 397 read with 401 Cr.P.C.

The revision petition is accordingly dismissed.
